Translucent has begun the process of taking legal action against the Equality and Human Rights Commission (EHRC), alleging that the EHRC is acting unlawfully in response to a Supreme Court judgment on trans people under the Equality Act by proposing an inadequately short two-week consultation and holding a predetermined view on how to update its statutory guidance, a belief reinforced by public statements from senior EHRC personnel. Statement Following the Supreme Court Ruling

At what has become an increasingly troubling time for all trans people and their families, TransLucent wish to send a message of support and our ongoing commitment to standing up and defending trans rights throughout the UK.

While the Supreme Court ruling has resulted in high levels of distress, technically, it only affects trans people with a GRC.

What is now imperative is that neither the government nor the EHRC give false information to single-sex service providers, implying that the Equality Act has changed or that the requirement for a “proportionate means to achieve a legitimate aim” to exclude no longer applies.

TransLucent have sought urgent clarification from the government that the message they portray is factual and does not add to the current levels of distress nor fuel any public action that impacts the safety of not only trans women but any women not conforming to a perceived level of femininity.
